darableKitten's Terms of Service (Updated: 11/01/2024)Thank you for your interest in my work! Please make sure to read through the T.O.S before contacting me about commissions. T.O.S Is subject to change at random so please stay up to date on this whenever you wish to commission me!GENERAL
- Adarablekitten has the right to refuse the request of a commission at any time for any reason.- Clients must be 18 years old or older in order to commission Adarablekitten for artwork.- As of (6/18/2024) I'm Testing out a First come First Serve Model. This may change in due time.- As a client, you understand that there is no physical item associated with this transaction.- As the artist I have the right to post commissioned work to my social media for promotional purposes, Stream my progress of the commissioned work as well as use the piece in my portfolio.- The files will be sent through email and/or a Valid Discord.- Please keep in mind that my art is constantly evolving, so there might be slight differences between the examples and the illustration you will receive.- The use of my art in AI Generators and/or as NFTs will result in a permanent ban via Blacklist.- Adarablekitten will NOT take requests that contain the following; NSFW themes, Including but not limited to, Explicit Adult media, Nudity, depictions of young individuals in Adult content, Content that Is offensive or discriminatory,- Adarablekitten however Will take commissions that may or may not include; soft suggestive themes including but not limited to; Kisses, Holding hands, Hugs, Pajama portrait's, undergarments not in explicit settings, Swimsuit Portraits. etc..PAYMENTS
- Prices are non-negotiable- Once the payment is made you are agreeing to my TOS.- Payments will be done through Vgen- Due to new laws for Digital Sales Tax. You may be subject to digital sales tax.- Payment must be made before I can start working. You will then be placed in my Trello line up, if there is no one ahead of you, then congratulations! I'll be working on your commission first!.- Tips are not mandatory BUT appreciated!- Payments Can be made as a 50% Non-refundable partial payment up front and a 50% payment near completion, Artwork will be released to client after payment is made in full, failure to pay in full will void your rights to the art and any Commercial use rights to said art.- If you pay in full in advance your Entitled to a 50% Refund in the events you cancel Commission, Or artwork is not received by the deadline or within 4 weeks after payment. Once the coloring stage has been made the final refund will be 25% based on the previous terms.DEADLINES AND DELIVERY
- delivery can take on average 1 - 4 weeks, although I will do my best to get commissions out in a timely manner before any deadlines.- Rushed order Fee: +50% of Total amount- Animated Commissions may be subject to longer than average delivery times.USE- All art will be for PERSONAL USE ONLY unless discussed and agreed to otherwise.- Do NOT edit, trace, modify or alter the piece in any way without my permission.- A commercial use agreement must be established before you can use any works commercially and for monetary value.- Adarablekitten is an Anti-AI image generator Artist and Prohibits the use of her works in AI Media and programs. This can and will result in a ban/Blacklist from my services- AI references are NOT allowed!. For references you are welcome to purchase one from me or another artist. Please be as detailed in your descriptions as possible.- You are also NOT Allowed to use or sell my art as NFTs. This can and will result in a ban from my servicesINTELLECTUAL PROPERTY
RIGHTS
- Credit must be given.- All Clients hold the right to their characters IP. All artwork made by Adarablekitten may be shared on social media as long as it contains proper credit to Adarablekitten as the artist, that includes all who have received art from me with commercial use rights.Adarablekitten Holds the right to post commissioned art work to social media for promotional purposes, as well as use the piece in her portfolio after the piece is completed.REFUNDS
- You may receive a Refund only if...
- You do not receive your DIGITAL commission 4 weeks after payment

- All Communication must be clear and proactive, you will be held to that responsibility as I will hold myself to it as well!- All works will be in stages and discussed and agreed to before moving on to the next stage, once agreed there is no going back to the previous step. We may communicate via Discord, Live stream chat and/or here on Vgen.- You will be placed in my Trello board progress report, you are welcome to check the progress of your
