By commissioning me, you agree to the terms listed below. These Terms of Service are subject to change at any time, but they are not retroactive.All commissions will have a record of when they were requested and agreed upon. You will be held to the Terms of Service that were active at the time your commission was placed.These Terms are governed by the laws of the The United States.2. Payment
Payment must be made through Vgen
Full payment upfront on all commissions under $150USD Commissions over $150USD are eligible for a payment plan!
Payments are non-refundable once work has begun.* (See Refunds & Cancellations)3 Usage Rights & CopyrightCharacter OwnershipThe client retains all rights to their original character intellectual property (IP), including but not limited to the character's name, personality, lore, concept, backstory, and other pre-existing character elements provided by the client.Copyright OwnershipBy commissioning me, you are purchasing a limited license to use the completed artwork and/or rigging only for the purposes explicitly granted under these Terms of Service.Unless otherwise agreed to in writing, I retain all copyrights and ownership rights to the artwork, rigging, source files, project files, and all related assets created as part of the commission.Standard commissions do not include copyright transfer, exclusive ownership, source files, or work-for-hire status.Clients seeking full copyright ownership, exclusive rights, or a work-for-hire arrangement must negotiate a separate written agreement signed by both parties prior to the start of the project. Additional fees will apply.Personal UsePersonal use rights are included with all commissions.Personal use includes, but is not limited to:Profile pictures Banners Personal social media posts Wallpapers Printing for personal display Other non-commercial usesCommercial Use (Monetization)Commercial use rights are not included unless explicitly stated in the commission listing, invoice, quote, or written agreement.Commercial use includes, but is not limited to:Monetized livestreams Monetized videos Sponsorships Advertisements Membership programs Subscription services Donations and tips associated with commissioned contentA Commercial Use License may be required and may incur an additional fee.Commercial Use (Merchandise)Merchandise rights are not included with standard commissions.Any use of commissioned artwork or models on physical or digital merchandise, including but not limited to:ApparelStickers Keychains Prints Posters Standees Digital products Promotional merchandiserequires the purchase of a Merchandise License and may incur an additional fee.Merchandise rights may not be available for all commission types.Credit RequirementsYou must credit me as the artist and/or rigger whenever the commissioned work is displayed, published, streamed, or distributed where reasonable and platform-appropriate.You may not remove, alter, crop out, obscure, or otherwise modify my signature, watermark, or artist mark from any artwork where one is present unless I have provided written permission to do so.AI, Machine Learning & NFT RestrictionsMy artwork, rigging, models, and related assets may not be used for:Artificial intelligence training Machine learning datasets Image generation systems Automated content generation systems Data scraping or dataset creation NFTs Blockchain projectsCryptocurrency-related projectsYou may not copy, trace, edit, manipulate, redistribute, resell, or create derivative works from my commissioned artwork except where expressly permitted by these Terms of Service.Any individual found violating these restrictions may be permanently banned from future commissions and services.VTuber Models & Live2D DeliverablesFor Live2D, and other VTuber model commissions, the client acknowledges that the editable project files, including but not limited to Live2D Cubism source files (.cmo3 and related project files), are not included in any standard commission deliverable.The client is purchasing a completed and functional model, not the underlying source files used in its creation.The client may not modify, alter, reverse engineer, or commission a third party to modify the rigging of the model without my prior written permission.Any future artwork revisions, model updates, outfit additions, expression additions, rigging adjustments, or similar modifications must be commissioned through me and are subject to my availability, pricing, and current Terms of Service.Additional fees will apply for any future modifications or updates.4. Process & Delivery
I will provide progress updates at least once every 2 weeks or when applicable by project type (sketch/lineart/coloring)Revisions are allowed during the sketch phase; minor color adjustments allowed after. (Excludes Skeb style commissions)Final artwork will be delivered digitally in respected format that may include (PNG, JPG, GIF, PSD, CLIP, MP4, MOV.....etc.) (Please be sure to check project description for file deliverable type)All works in its raw form will be saved on file for up to 3 Years, so please be sure to backup your commission when you receive it in the most secure manner possible. For LIVE2D Rigs, the Source file will be backed up indefinitely.All commissions are digital services only. No physical items will be shipped.5. Client ResponsibilitiesPlease provide clear references and instructions before work begins. Be as detailed as possible, even music references can help me get the overall vibe of your project.
Please provide any applicable files necessary for your project needs.Respond in a timely manner to questions or updates.6. Artist RightsI retain all copyright and ownership of the artwork, rigging, models, source files, project files, and all related assets created as part of the commission, unless otherwise agreed in writing before the start of the project.The client is granted only the usage rights outlined in these Terms of Service. No copyright transfer, exclusive ownership, source files, or work-for-hire rights are included unless a separate written agreement is made prior to the start of the commission.I retain the right to post and display all commissioned work in my portfolio, social media, and promotional materials, unless otherwise agreed (such as an NDA or confidentiality agreement).If an NDA or confidentiality period is agreed upon, I will not publicly post the work until that period has ended, even if the project is completed or closed.Unless otherwise agreed, I retain the right to use commissioned artwork for self-promotion and merchandise, including but not limited to prints, portfolio books, and other promotional materials.I reserve the right to refuse a commission request for any reason.I will NOT create work involving hate speech, explicit sexual content involving minors, or copyrighted characters such as Disney, SpongeBob SquarePants, etc., unless proper rights or permission are provided.*7. Refunds & CancellationsIf I, the artist, cancel the commission prior to starting work after payment has been received, you will receive a full refund.Refunds are not available once work on the commission has begun.If a commission is canceled after work has started, no refund will be issued. You will not receive any completed or in-progress work, and all rights to any unfinished or completed work remain with the artist.I do my best to provide high-quality artwork and ensure client satisfaction. If any issues arise, please contact me directly so they can be resolved.Chargebacks are considered a violation of these terms and may result in permanent refusal of future services.By commissioning me, you agree that work may begin immediately upon payment.8.
